Cut your electricity and fixed contract costs in France: the guide for small businesses
This guide only concerns businesses registered in France (French law, French suppliers and French bodies). The rules, tariffs and bodies described are French, and the template letters are kept in French because they are sent to French companies.
Electricity, insurance, phone, bank, card terminal: these contracts renew on their own and creep up without anyone noticing. This guide explains, rule by rule, what French law really allows a small business or a self-employed person to do in 2026, how to put each contract back out to competition, and gives you six template letters ready to copy.
Information checked on 18 October 2026
In short
Electricity: if your business employs fewer than 10 people and does not exceed €2 million in turnover, receipts or balance sheet total, you are entitled to EDF's regulated tariff (TRVE, tarif réglementé de vente d'électricité), whatever the meter's power rating since 1 February 2025. First compare with the free comparison tool of the médiateur national de l'énergie (the French national energy ombudsman).
Before leaving an energy offer: check the exit fees. A fixed-price, fixed-term contract can be expensive to terminate early.
Business insurance: cancellation "at any time" (loi Hamon) is reserved for private individuals. For a professional, the rule is still cancellation at the renewal date, with at least two months' notice, unless your contract says otherwise. A new right to cancel after one year for small and medium businesses (TPE and PME) has been passed but is still waiting for its implementing decree.
Phone and internet: for a micro or small business, the commitment cannot exceed 24 months, unless you waived this in writing. After an automatic renewal, you can leave with no more than 10 days' notice.
Bank: business fees are unregulated, and therefore negotiable. Closing an account has been free, including for a company, since 28 May 2026.
Method: block out one afternoon a year, gather your contracts, note the renewal dates, request two competing quotes per item, then negotiate or cancel using the letters on this page.
1. Electricity and gas: return to the regulated tariff and compare
Who is entitled to the regulated tariff (TRVE) in 2026?
The regulated electricity tariff is EDF's "tarif Bleu" (or that of the local distribution company in some municipalities). Its price is proposed by the Commission de régulation de l'énergie (CRE, the French energy regulator) and set by the public authorities. The access rule for businesses is set out in article L. 337-7 of the Code de l'énergie (French Energy Code).
Criterion

Code de l'énergie, art. L. 337-7, II
If your business grows
You must terminate the TRVE contract as soon as you no longer meet the criteria
Code de l'énergie, art. L. 337-7, III
Territory
Mainland France. In Corsica and the overseas territories (zones non interconnectées, i.e. areas not connected to the mainland grid), the TRVE is open to all business sites
CRE; Code de l'énergie, art. L. 337-8
The TRVE is not always the cheapest. It is a stable, regulated reference price, not a guarantee of the best price. Some market offers are cheaper, others much more expensive. Compare before switching.
How to return to the regulated tariff
Check your eligibility (headcount, turnover or balance sheet) using your latest annual accounts.
Read your current contract: term, end date, notice period and above all early termination fees. The energy ombudsman advises asking your supplier for the exact amount before making any move.
Find your delivery point number (PDL or PRM, 14 digits) on your bill or on your meter.
Apply to EDF (or to the local distribution company in your municipality). For the tarif Bleu, EDF Entreprises says it works through a callback request; a written request (letter 1 below) leaves a record. Above 36 kVA, EDF offers regulated tariffs called "Jaune" and "Vert". One request covers one site only.
Fill in the eligibility certificate (attestation d'éligibilité) that the supplier sends you.
Termination fees: what the law says for businesses
Meter of 36 kVA or less
The "no termination fees" rule (Code de la consommation, art. L. 224-15) applies to businesses that employ fewer than 50 people and whose turnover or balance sheet is below €10 million, on a sworn statement (attestation sur l'honneur) (Code de l'énergie, art. L. 332-2).
Important exception: for a fixed-price, fixed-term contract that you leave before it ends, fees may be charged. They must have been disclosed before signing and cannot exceed the supplier's direct economic loss.
Meter above 36 kVA, and gas
Above 36 kVA, the law does not extend this protection (Code de l'énergie, art. L. 332-2-1): exit fees depend on your contract.
For gas, the protection on termination fees is not extended to businesses either (Code de l'énergie, art. L. 442-2). Read your contract.
In all cases, the best time to switch is the end date of your contract.
The official comparison tool of the médiateur national de l'énergie
The médiateur national de l'énergie, an independent public authority acting as the national energy ombudsman, offers a free comparison tool (in French) at comparateur.energie-info.fr. The law provides it for business customers who subscribe 36 kVA or less of electricity, or who consume less than 300,000 kWh of gas per year (Code de l'énergie, art. L. 122-3). Above that, request quotes directly from suppliers. A micro-enterprise can also refer a dispute to the same ombudsman free of charge, after a written complaint that has not been resolved (Code de l'énergie, art. L. 122-1).
Beware of cold callers: the ombudsman has already reported salespeople using its name. It will never call you to sell you an offer.
Taxes, price shield and support in 2026
The excise duty on electricity (accise sur l'électricité, formerly CSPE) is set by law: it is the same with every supplier and cannot be negotiated. Its rates changed on 1 February and again on 1 August 2026 (loi de finances pour 2026, the 2026 Finance Act). The amount applied appears on your bill.
Reduced excise rates: certain specific uses qualify, on a certificate given to the supplier (form 2040-TIC-ATT-E-SD, according to EDF Entreprises). If in doubt, ask your service des impôts des entreprises (business tax office).
Price shield and "amortisseur": the amortisseur électricité (electricity price cushion for businesses) ended on 31 December 2024. We have not identified any equivalent general support in force in 2026.
Gas: there is no longer a regulated gas tariff. You are necessarily on a market offer: compare at the end of each contract, using the comparison tool if you consume less than 300,000 kWh per year.
2. Business insurance: renewal date, notice and competing quotes
This is where people make the most mistakes: many protective rules familiar to the general public only apply to private individuals. Here is what really applies to a contract taken out for your business.
Rule
For a professional
Legal text
Annual cancellation at the renewal date
Yes. You can cancel after one year by notifying the insurer at least two months before the renewal date. The period runs from the postmark or the date of sending.
Code des assurances, art. L. 113-12
Different clause in the contract
Possible. For risks other than those of private individuals, the contract may depart from annual cancellation. Read the term and cancellation conditions of your policy.
Code des assurances, art. L. 113-12
How to notify
Letter or any other durable medium (email included), declaration at the head office or with the agent, deed served by a commissaire de justice (bailiff), or any method provided for in the contract. The insurer must confirm receipt in writing.
Code des assurances, art. L. 113-14
Deadline reminder on the renewal notice (loi Chatel)
No. Reserved for individuals acting outside their professional activity.
Code des assurances, art. L. 113-15-1
Cancellation at any time after one year (loi Hamon)
No. Reserved for individuals acting outside their professional activity (car, home, add-on insurance, supplementary health cover).
Code des assurances, art. L. 113-15-2
New: cancellation after one year for small and medium businesses (TPE and PME)
Passed, not yet applicable. For contracts covering direct damage to business property (premises, equipment, stock), cancellation free of charge after one year, effective one month after notification. It will only apply to contracts concluded or renewed after publication of a decree, which we had not found published as of 18 October 2026. Some contracts will be excluded by this decree.
Code des assurances, art. L. 113-15-2-1 (loi n° 2026-403 du 26 mai 2026)
If the insurer cancels your contract
It must give reasons for its decision, including for a professional, since 28 May 2026.
Code des assurances, art. L. 113-12-1
Your risk has decreased
You are entitled to a lower premium. If the insurer refuses, you can terminate the contract: cancellation takes effect 30 days later.
Code des assurances, art. L. 113-4
Change of profession, permanent cessation of business, retirement
Cancellation possible within three months of the event, if the insured risk disappears. Effective one month after notification, without penalty.
Code des assurances, art. L. 113-16
Getting competing quotes without taking risks
Start three to four months before the renewal date: you need time to obtain quotes, then to send the cancellation at least two months beforehand.
Compare like for like: limits, deductibles, exclusions, insured value of equipment and stock, business interruption. A lower premium with a tripled deductible is not a saving.
Update your declarations: turnover, headcount, floor area, activities carried out. An overstated base makes you pay too much; an understated base exposes you to reduced compensation.
Never cancel before the new contract is signed, especially for insurance that is compulsory in your trade (for example the garantie décennale, the 10-year liability insurance in construction, or the professional liability insurance of certain regulated professions).
Using a broker (courtier): a broker approaches several insurers for you. Check their registration on the official register of insurance intermediaries, orias.fr.
3. Business phone and internet: commitment and termination fees
The protective telecom rules of the Code de la consommation (French Consumer Code) only apply to some businesses. The exact list is in article L. 224-26-2 of the Code de la consommation.
Rule
Who benefits
Legal text
24-month maximum commitment
Micro-enterprises and small businesses (in the EU sense: fewer than 50 employees and annual turnover or balance sheet not exceeding €10 million), unless they have expressly waived this protection in the contract
Code de la consommation, art. L. 224-28, I and L. 224-26-2
After an automatic renewal: leave at any time, 10 days' notice maximum, free of charge
All end users, and therefore all businesses
Code de la consommation, art. L. 224-40 and L. 224-26-2
Information about the end of the commitment, between three months and one month before renewal
All end users
Code de la consommation, art. L. 224-40
Contract changed by the operator: termination free of charge within four months
All end users (except a change solely to your benefit, purely administrative or required by law)
Code de la consommation, art. L. 224-33 and L. 224-26-2
Adding an option does not extend the commitment, unless expressly agreed
Micro-enterprises and small businesses, unless expressly waived
Code de la consommation, art. L. 224-42-2, III
Keeping your number at no direct cost: porting terminates the old contract
All subscribers (remaining commitment periods are still payable)
Code des postes et des communications électroniques, art. L. 44-4
Early termination from the 12th month with partial payment of the remainder
Private individuals only. For a business, the early termination fees are those set in the contract.
Code de la consommation, art. L. 224-28, II
Look for the waiver clause: some business contracts contain an express waiver of the protections of article L. 224-26-2. If you signed it, the commitment may exceed 24 months.
Doorstep selling: if you have 5 employees or fewer and you sign, on your premises, a contract unrelated to your main activity (telephony, website, rented card terminal), you have the same 14-day withdrawal right as a private individual (Code de la consommation, art. L. 221-3).
Equipment: mention in your letter the return of the rented box or phones, to avoid non-return fees.
4. Banking and card payments: fees, commissions, terminal
Business account fees
Business fees are unregulated. The caps known to the general public (incident fees, offer for financially vulnerable customers, basic banking service) concern private individuals. As a result, everything is negotiable, and competition is your best argument.
Fee changes: the law provides for two months' notice before any change to the payment services contract, but for a professional the contract may provide otherwise (Code monétaire et financier, art. L. 314-13 and L. 314-5). Read your account agreement.
Free closure: closing any deposit account is free, whether the holder is an individual or a company, since 28 May 2026 (Code monétaire et financier, art. L. 312-1-7, I, introduced by loi n° 2026-403).
Annual statement of fees for micro-enterprises: the law of 26 May 2026 provides for it, but the two official sources do not give the same start date (28 May 2026 according to economie.gouv.fr, 2027 according to entreprendre.service-public.fr). In the meantime, ask your adviser for this summary.
Switching banks: the statutory bank switching service (automatic transfer of direct debits and transfers) is reserved for private individuals in the text we consulted. Many banks offer it to businesses anyway: ask for it.
Refusal to open an account: a business domiciled in France without an account can refer the matter to the Banque de France with the refusal letter, and the Banque de France designates a bank that is required to open an account for it (droit au compte, the right to a bank account, Code monétaire et financier, art. L. 312-1).
Card payment commissions
Every card payment costs you a merchant service charge (commission de service commerçant), made up of three parts: the interchange fee (paid to the customer's bank), the network fees (CB, Visa, Mastercard) and the margin of your bank or payment provider. Only the third part is really negotiable, but the other two are regulated.
European rule
What it means for you
Legal text
Interchange capped at 0.2% for debit cards and 0.3% for consumer credit cards
If your total rate is well above these levels for European consumer cards, it is your provider's margin that weighs: negotiate it. Commercial cards (business cards), cards issued outside the EU and cards from so-called three-party schemes (such as American Express) are not covered by these caps.
Regulation (EU) 2015/751, art. 3 and 4
Itemised billing by card brand and category
Your provider must state separately the merchant service charge, the interchange fee and the network fees, unless you have requested blended pricing in writing.
Regulation (EU) 2015/751, art. 9 and 12
Choice of brand on a co-badged card
You can set your terminal to give priority to the network that is cheapest for you (often a choice between CB and Visa or Mastercard), while the customer keeps the option of choosing the other one.
Regulation (EU) 2015/751, art. 8(6)
Card payment terminal: rent or buy?
Renting (often offered by the bank)
No upfront cost, maintenance and replacement often included.
Check the commitment period, the notice period and the total cost over the whole term: a modest monthly rent can end up costing several times the purchase price.
The rental and the card acceptance contract are sometimes two separate contracts, with two different notice periods.
Buying, or a payment provider's terminal
An upfront cost, then a commission per transaction, often with no subscription.
Compare on your real volume: number of payments per month and average transaction value. A single-rate formula is simple but not necessarily cheaper than a package.
Check the additional fees: payouts, refunds, non-European cards, chargebacks.
Neobanks and online business banks
Check the status: credit institution, payment institution or electronic money institution. All authorised institutions appear in the official register regafi.fr (Banque de France and ACPR, the French banking supervisor).
It is not the same protection: the deposit guarantee covers credit institutions. A payment institution must protect its customers' funds in another way (safeguarding). Ask which one applies.
Check the needs of your trade: cash deposits, cheque collection, overdraft, credit, card terminal. A low subscription can quickly rise with options.
How to negotiate with your bank
Add up everything you pay over 12 months: account fees, cards, transaction fees, card commissions, terminal rental, incident fees.
Get at least one written competing offer on the same basis (your real volumes).
Send letter 4 below to your adviser, with the offer attached, and set a reply date.
Without a satisfactory answer, open the new account before closing the old one, then transfer the direct debits.
5. The method: an annual review in one afternoon
Choose a fixed date in the year, ideally four months before the renewal date of your largest insurance contract, and follow these steps.
2 pm: gather
The last 12 electricity and gas bills, with the PDL or PCE number (delivery point) and the subscribed power.
The specific terms (conditions particulières) of each insurance policy and the latest renewal notice.
The phone and internet contracts, with the end date of the commitment (it must appear on the bill).
The bank statements and the card commission statement for the last 12 months.
Your latest annual accounts (headcount, turnover, balance sheet total).
3 pm: build the table
For each contract: supplier, annual cost, renewal date, notice period, exit fees.
Calculate the deadline for sending each cancellation (renewal date minus notice period, minus a 15-day margin).
Put these dates in your calendar with a reminder.
Spot duplicates: two phone lines, insurance covering equipment you have sold, unused options.
4 pm: compare and act
Electricity and gas: run your profile through the ombudsman's comparison tool.
Insurance: request two quotes with equivalent cover, or ask a broker to do the search.
Bank and card: request a written offer from a competitor.
Send the renegotiation letters, then, depending on the answers, the cancellation letters.
File the acknowledgements of receipt with the contracts.
Annual checklist
Is my business still eligible for the TRVE (fewer than 10 people, €2 million maximum)?
Does my subscribed electrical power match my real needs?
Have I compared my electricity and gas offer this year?
Have I noted the renewal date and notice period of each insurance policy?
Are my insurance declarations (turnover, headcount, floor area, equipment) up to date?
Do I have at least one competing quote for my main insurance policies?
Have my phone and internet commitments expired? Have I been renewed automatically?
Am I paying for lines, options or equipment I no longer use?
Do I know the annual total of my bank fees and card commissions?
Is my card terminal rented? Until when, and at what total cost?
Have I checked my bills for wrongly charged fees?
Are the next cancellation deadlines in my calendar?
6. Template letters ready to copy
These letters are deliberately written in French: they are sent to French suppliers, insurers, operators and banks. Replace the passages in square brackets (they describe in French what to fill in), delete the paragraphs marked as optional ("Paragraphe optionnel") if they do not apply to you, then send the letter by registered post with acknowledgement of receipt (lettre recommandée avec accusé de réception), or by any means that leaves a dated record (email with acknowledgement, customer account).
Letter 1. Request to switch or return to the regulated tariff (EDF)

Good to know: for an electricity or gas dispute, a micro-enterprise can refer the matter free of charge to the médiateur national de l'énergie if this written complaint has not solved the problem (Code de l'énergie, art. L. 122-1). Keep a copy of everything you send.

Frequently asked questions
My business has 12 employees: can I get the regulated electricity tariff?
No. The Code de l'énergie (French Energy Code) reserves the TRVE for businesses that employ fewer than ten people and whose turnover, receipts or balance sheet total do not exceed €2 million. Above that, you need a market offer, to be compared by requesting several quotes.
Is the regulated tariff always the cheapest?
No. It is a regulated, stable price, but some market offers are cheaper at a given time and others more expensive. Compare with the comparison tool of the médiateur national de l'énergie (French national energy ombudsman) before switching, and check the exit fees of your current contract.
Can I cancel my business insurance at any time, like a private individual?
Not yet. Cancellation at any time after one year (loi Hamon) is reserved for private individuals. The law of 26 May 2026 creates a similar right for small and medium businesses (TPE and PME) on contracts covering damage to business property, but it is still waiting for a decree. In the meantime, the rule is cancellation at the renewal date, at least two months in advance, unless your contract says otherwise.
Can my operator lock me in for 36 or 48 months?
If you are a micro or small business (fewer than 50 employees and €10 million in turnover or balance sheet total), the commitment cannot exceed 24 months, unless you expressly waived this protection in the contract. Above that size, the contract decides.
Can my bank charge me for closing my business account?
No. Since 28 May 2026, closing any deposit account is free, whether the holder is an individual or a company. Other business fees remain unregulated, and therefore negotiable.
Should I rent or buy my card payment terminal?
It depends on your volume. Calculate the total cost of renting over the whole commitment period and compare it with the purchase price plus a payment provider's commissions. Also check the cancellation notice period, which is often different from that of the card acceptance contract.

Information checked on 18 October 2026 using the consolidated texts and official pages above. Two points were still uncertain at that date: the publication of the implementing decree for the new insurance cancellation right for TPE and PME (article L. 113-15-2-1), and the exact start date of the annual bank fee statement for micro-enterprises. Check them before relying on them.
